Terms of Use

These Terms of Use ("Terms") govern your access to and use of the construction scheduling and team management platform (the "Service") operated by GINKGO PRO LTD, trading as GO CONSTRUCTION ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

Your account

• You must provide accurate information when registering and keep it up to date.
• You are responsible for keeping your password secure and for all activity under your account.
• You must not share your account credentials or allow unauthorised access.

Subscriptions and billing

Some features of the Service are provided on a subscription basis. Subscription fees, plans and billing cycles are presented within the Service. You authorise us to charge the fees for your selected plan until you cancel. Fees are generally non-refundable except where required by law.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in breach of these Terms.
• Upload content that infringes the rights of others or is harmful, defamatory or unlawful.
• Attempt to disrupt, overload or gain unauthorised access to the Service or its systems.
• Misuse the Service to send unsolicited communications.

Your data

You retain ownership of the company and project data you enter into the Service. By submitting it, you grant us the rights needed to operate the Service for you. You are responsible for having the right to share any personal data of others (such as team members or suppliers) that you enter into the Service.

White-label

Where your account is configured for white-label use, custom branding (such as company name, colours and logos) is applied to your instance of the Service. You are responsible for ensuring you have the rights to use any branding, logos or trade marks you upload. We may display our own branding where white-label is not enabled.

Service availability

We strive to keep the Service available but do not guarantee uninterrupted access or any minimum uptime. We may update, change or remove features, and may suspend access for maintenance, security or operational reasons, with or without notice.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential losses arising from your use of, or inability to use, the Service. Our total liability is limited to the fees you paid to us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you breach these Terms or if we stop providing the Service. Upon termination, your right to use the Service ends; we may delete your data in line with our retention practices.

Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above. Continued use of the Service after changes indicates acceptance of the updated Terms.
